Terms of Use

These terms govern use of the Neptooner® platform. They do not replace the Digistore24 reseller’s purchase terms.

1. Platform operator and scope

Represented by Mike Gassen. Contact: info@neptooner.ai.

At launch, this service is aimed at users in Germany. These terms apply to use of Neptooner® access purchased through Digistore24. The purchase contract is concluded with the Digistore24 reseller named at checkout. MG Dynamics LLC is the product developer and platform operator.

2. User account

Please provide accurate registration details and keep the information required for your access up to date. Protect your login credentials from unauthorised access and do not share them for improper use. Let us know if you notice misuse of your account.

3. What Neptooner® offers

Neptooner® supports AI-assisted creation and editing of designs and images, as well as preparation of product artwork. The specific service depends on the selected plan and the features described at the time of ordering. Your access is activated immediately after a successful purchase.

4. Paint Drops

Paint Drops are usage credits within Neptooner®. One design variation costs 1 Paint Drop. One enhancement costs 5 Paint Drops. You can generate 1, 2, 4 or 8 variations. The cost is displayed before an action that uses credits is carried out.

Monthly plans include 600 Paint Drops (Starter), 1,300 Paint Drops (Creator) or 2,200 Paint Drops (Pro). Unused subscription Paint Drops expire at the end of the respective billing period. They do not roll over to the following month.

Additional Paint Drops can be purchased separately through Digistore24. The validity rules for subscription credits do not automatically apply to separately purchased credits. The conditions for an additional purchase must be stated before that purchase.

Paint Drops cannot be redeemed for cash. Statutory rights, including refunds following a valid withdrawal or service failures, remain unaffected.

5. AI results and third-party rights

AI-generated results may vary. We do not guarantee a particular image, a unique result or freedom from third-party rights.

Before publishing or using a design commercially, check whether it affects copyright, trademark rights, personality rights or other rights. An image created with Neptooner® is not automatically legally cleared for every purpose. Only upload content and use inputs that you are entitled to use.

6. Prohibited use

• Illegal content and infringements of copyright, trademark rights or personality rights.
• Misuse, technical attacks and disruption of the platform.
• Circumventing usage restrictions or Paint Drop limits.
• Automated extraction or manipulation outside expressly provided features.

7. Availability and development

Maintenance, updates and technically necessary interruptions may temporarily affect availability. Uninterrupted availability is not guaranteed. Statutory rights in the event of disruption remain unaffected.

Features may be updated, improved or replaced as the technology develops, provided the essential nature of the purchased service is retained. Statutory requirements for changes to digital products, required notices and any applicable termination rights remain unaffected.

8. Payment and monthly subscription

Plans cost €19.90 (Starter), €39.90 (Creator) or €69.90 (Pro) per month. Payment, invoicing and purchase administration are handled exclusively through Digistore24. The terms provided in the Digistore24 checkout apply to the purchase.

The billing period is one month. Your subscription renews automatically each month unless you cancel. Cancellation takes effect at the end of the current billing period. The minimum contract term is one month.

9. Cancellation and withdrawal

Recurring payments are cancelled through Digistore24. Cancellation stops renewal at the earliest possible date. The period already paid for can generally be used until it ends; statutory rights and the terms applicable to the specific order remain unaffected.

10. Suspension for misuse

In the event of serious legal violations or substantial misuse, access may be restricted or suspended to the extent necessary. We consider the severity, consequences and interests of both parties. Where possible and reasonable, we will inform you beforehand and provide an opportunity to clarify or resolve the issue. Immediate temporary suspension may be necessary in the event of acute security risks. Suspension is not a blanket basis for retaining payments already made.

11. Liability and statutory rights

Statutory liability rules apply. In particular, claims relating to intent, gross negligence or injury to life, body or health are not excluded. Mandatory rights in the event of defective digital services also remain unaffected.

These terms neither exclude nor restrict statutory consumer rights. No choice of law or exclusive place of jurisdiction outside Germany is agreed here. Mandatory German and European consumer protection provisions remain applicable where their conditions are met.
